1. Acceptance of these Terms

These Terms and Conditions (“Terms”) govern your access to and use of the DRM HealthLink^™ platform, including DRM HealthLink CarePoint^™ kiosks, DRM HealthLink^™ Home Kits, the DRM HealthLink^™ mobile application and patient portal, teleconsultation services, and this website (together, the “Services”), operated by DRM Pharma & Diagnostic GmbH, Odenwaldring 41, 63110 Rodgau, Germany (“DRM”, “we”, “us”). By registering for or using the Services you accept these Terms. If you do not agree, please do not use the Services.

2. What the Services are, and what they are not

• The Services provide health screening, measurement, rapid testing, AI‑supported health assessment, teleconsultation with licensed physicians, digital reports, and secure health records.

• Screening results support early detection and prevention. They are not a medical diagnosis. Only a licensed physician can diagnose a condition and prescribe treatment.

• Any AI‑generated content including risk indications and meal plans produced by DRM CarePoint AI^™ is informational support. Clinical decisions are always made by licensed physicians.

• The Services are not designed for emergencies. Kiosks, apps, forms, and messaging channels are not monitored for urgent medical situations.

3. Eligibility and registration

You must provide accurate registration details and keep them up to date. You are responsible for maintaining the confidentiality of your account credentials and one time codes. The Services are intended for adults; minors may use them only with the consent and involvement of a parent or legal guardian where local law permits.

4. Teleconsultation

Teleconsultations are provided by licensed physicians. Physicians exercise independent professional judgment and may decline to provide advice or prescriptions where a physical examination or further investigation is required. Prescriptions are issued at the physician’s sole discretion and in accordance with applicable law. Availability of specific medicines depends on the dispensing pharmacy.

5. Test results and Home Kits

• Point of care and rapid test results have recognised performance characteristics and limitations. A negative screening result does not guarantee the absence of a condition, and a positive screening result requires confirmation by a physician or laboratory.
• Home Kits must be used according to the instructions provided. DRM is not responsible for results affected by incorrect use, storage, or expired kits.
• Certain tests (as indicated in our test menu) are dispensed as kits for home use and are not performed inside the kiosk.
• Test availability may vary by market and is subject to local regulatory approval.

6. Your obligations

• Use the Services only for lawful, personal health purposes, or authorised organisational purposes under a partnership agreement.
• Provide truthful health information during intake and consultations.
• Do not misuse, damage, or tamper with kiosks, devices, or consumables, and follow on screen hygiene instructions.
• Do not attempt to access other users’ data, reverse engineer the platform, or interfere with its security.

7. Fees

Applicable test and consultation fees are displayed before you confirm a service. Fees may vary by market, deployment, and sponsor arrangements (for example employer funded programmes). Where required, taxes are included or displayed separately.

8. Intellectual property

DRM HealthLink^™, DRM CarePoint^™, DRM CarePoint AI^™, the DRM HealthLink^™ logo, and all platform software, designs, and content are the property of DRM Pharma & Diagnostic GmbH or its licensors and are protected by intellectual property laws. No rights are granted except the limited right to use the Services in accordance with these Terms.

9. Privacy and data protection

Our processing of personal data, including health data, is described in our Privacy Policy, which forms part of these Terms. Health data is processed only with your explicit consent or as otherwise permitted by applicable law.

10. Availability and changes to the Services

We aim for high availability but do not guarantee uninterrupted operation. Kiosk locations, features, and the test menu may change, and individual devices may occasionally be unavailable for maintenance or calibration. We may update the Services and these Terms; material changes will be notified through the platform or this website.

11. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” without warranties of any kind beyond those that cannot be excluded. DRM does not warrant that any screening will detect every condition. Nothing in these Terms excludes or limits any statutory consumer rights that cannot be excluded or limited under applicable law.

12. Limitation of liability

DRM is liable without limitation for intent and gross negligence, for injury to life, body, or health, and under mandatory statutory liability regimes such as product liability law. For slight negligence, DRM is liable only for breach of essential contractual obligations, limited to the foreseeable damage typical for this type of contract. Any further liability is excluded to the extent permitted by law. Physicians providing teleconsultations are responsible for their own professional advice in accordance with applicable professional law.

13. Indemnity

You agree to indemnify DRM against claims arising from your misuse of the Services or breach of these Terms, to the extent permitted by applicable law.

14. Suspension and termination

We may suspend or terminate access for misuse, security risks, or breach of these Terms. You may stop using the Services and request deletion of your record at any time, subject to legal retention duties described in the Privacy Policy.

15. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection provisions of the country where you habitually reside remain unaffected, and any statutory jurisdiction rules for consumers continue to apply. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.

16. Severability

If any provision of these Terms is held invalid, the remaining provisions remain in full force and effect.
